PPP PROJECTS UNDER PRE-CONTRACT REGULATIONS AS AT NOVEMBER 07, 2017

1 Federal Ministry of Power, Works & Housing Lagos – Ibadan Expressway:

The 127km Lagos to Ibadan Expressway is a very important highway in the country, but is presently in a gravely dilapidated state. The road “as is” is a dualized carriageway with lay byes in designated areas along the stretch of the road. The re-construction, rehabilitation and expansion of the road, as currently proposed, is divided into two separate sections; to be undertaken by different Construction Contractors.

Roads & Bridges The Commission has granted a Full Business Case (FBC) Compliance Certificate for the Financing Arrangement (which does not cover Operations and Maintenance of the road). However, the FBC certificate confers on Motorways Asset Limited (MAL) the revenue rights during the Tolling, Operations and Maintenance (TO&M) Phase of the project.

The Infrastructure Bank Plc is assisting the Federal Government in raising funding to cover the Engineering, Procurement and Construction (EPC) funding gap.

2 Federal Ministry of Power, Works & Housing Improvement of Apakun-Murtala Muhammed International Airport (MMA) Road Route No. F269:

The MMA Apakun road is currently a 4-lane dual carriageway and FMPWH wishes to expand and upgrade it to a modern 8-lane facility with 2.75m shoulders on either side, including construction of vehicular bridges and pedestrian bridge at appropriate locations.

The actual length of the road is 3.6km. Access control onto the main road has been restricted at the relevant locations to ensure that airport bound traffic is impeded to a minimum. On the proposed road, there are 2-way single carriage ways on both sides to service both the communities of Ajao Estate and Mafoluku.

3 Federal Ministry of Power, Works & Housing Ilorin-Jebba-Mokwa-Tegina-Kaduna Road:

The Ilorin to Kaduna road passes through three states namely Kwara, Niger and Kaduna and comprises of seven major road segments with a total length of 480km.  This  length  is,  however,  exclusive  of  any  diversions / realignments  that  might  have  to  be incorporated in the alignment for geometric improvements.

The route starts from end point of existing 4-lane Ogbomoso-Ilorin expressway (which is approximately 2.8km north of Ilorin town), and runs along north-east direction to meet A124 road via Bode Shadu, Jebba and Mokwa. After that, it runs in the same north-east direction to reach Tegina where it meets with A125 road. The route continues in the same direction till Birnin-Gwari and then along east direction to reach Kaduna. The exact end point of the study corridor is located about 15km west with respect to junction of A125 and A2 road (which is already a 4-lane stretch at present).

4 Federal Ministry of Power, Works & Housing Abuja-Kaduna-Kano Dual Carriageway: The Federal Government of Nigeria has taken up this road for widening and strengthening on economic considerations with private sector participation.

This project road stretches between Abuja (Capital City of Nigeria) at Km 0+000 and Kaduna at Km166+000. This project road starts from the interchange with Western by-pass and ends at Rigachuku in Kaduna State. Abuja – Kaduna Road is a major North – South route cutting across Niger and Kaduna State of the Nigeria. The Dual Carriageway is the major link between the North-west Geopolitical zone and the national seat of Government. This area is characterized by mixed leguminous woodlands.

Roads & Bridges The Ministry is in the process of procuring a Transaction Adviser (TA) to prepare an Outline Business Case (OBC) as to determine the project’s viability and bankability. This would take into consideration the recent remedial works on the road in order to facilitate the use of the Kaduna Airport following the closure of Abuja Airport for maintenance works.

5 Federal Ministry of Power, Works & Housing Shagamu-Benin-Asaba Dual Carriageway:

The Shagamu – Benin and Benin – Asaba Federal Highways A121 and A232 is a dual carriageway, which covers a distance of over 368km, within the Western Region of Nigeria. Highway A121 commences at Shagamu in Ogun State, through Ore in Ondo State and bypasses Benin in Edo State. The latter Highway A232 commences at Benin in Edo State and terminates in Asaba, Delta State.

The route from Shagamu to Asaba traverses four states: Ogun, Ondo, Edo and Delta and links two state capitals: Benin City and Asaba. The four states account for a combined 15.4 million people or some 10% of Nigeria’s population. In addition, the road connects Nigeria’s largest city Lagos – population quotations range from 8 to 15 million to the East of the country.

6 Federal Ministry of Power, Works & Housing Onitsha-Enugu-Port Harcourt Dual Carriageway:

The Port Harcourt-Enugu expressway is part of the A3 Federal Road that serves the East as well as the North East of Nigeria through Benue State crossing the Benue River at Makurdi. The rehabilitation and modernization of a 210-kilometer section of the Enugu-Port Harcourt expressway is one of the primary objectives of the Federal Government of Nigeria. The Enugu-Port Harcourt expressway starts at the NNPC Mega Fuel Plaza outside the city of Enugu and ends at Eleme junction, 10Km after the Imo River at the boundary of the city of Port Harcourt.

7 Federal Ministry of Power, Works & Housing Construction of a bridge over River Katsina Ala at Buruku, Benue State:

The River Katsina Ala Bridge crossing (N70 27.468, E9 12.3680) at Buruku is situated in the North Central region of Nigeria, in Benue State, 32 km north east of Gboko town.  The project area falls within the Benue trough. This has a predominantly low-lying terrain (100 – 250m) and a rock base that is largely sedimentary, although there are croppings of igneous rock.

Construction of the 2nd Niger Bridge: The new 2nd Bridge and link road allowing for six lanes of traffic, three in each direction, under the scope of Phase 1, will have a total length of 11.9 km combining three sections. Roads & Bridges A new financing arrangement through the issuance of Government Bond to raise requisite finances for the realization of the proposed Bridge was considered at a PDT meeting on 10th October, 2017 with the Nigeria Sovereign Investment Authority (NSIA),  Debt Management office (DMO) and FMPWH (Works).

10 Federal Ministry of Transportation / Akwa Ibom State Government Ibom Deep Sea Port Project (IDSP):

The Ibom Deep Sea Port (IDSP) project involves the development of a Greenfield Deepsea Port and accompanying Free Trade Zone (FTZ) in Akwa Ibom State in the South-South geopolitical zone of Nigeria. The proposed Port and FTZ are part of the proposed Ibom Industrial City initiative that will be established on a 14,400 hectare site donated by the Akwa Ibom State Government (AKSG) at no value. The IDSP project is intended to become a major national and regional economic gateway that will provide additional container handling capacity for the country. In addition to containers, the IDSP is expected to handle petroleum products (export and import), crude oil and natural gas (export), vehicles (import) and bulk trade in natural resources (import and export).

It is planned to be the deepest port in the West African sub-region.

 

Ports The Commission granted an Outline Business Case (OBC) Compliance Certificate to the project on October 8th, 2014. Thereafter, the Federal Executive Council (FEC) approved the OBC on 11th May, 2015. The Federal Ministry of Transport and Government of Akwa Ibom are required to proceed with the project procurement phase. PWC Nig. Ltd has been appointed the as project managers.

11 Federal Ministry of Transportation / Nigeria Ports Authority Kirikiri Port Lighter Terminals I & II:

The Kirikiri area is part of Tin Can Island Port Complex (TCIPC) and is located about 1,500m away from the Western tip of Tin Can Island, along a channel connected to Badagry Creek. Over three decades the terminal infrastructures have been decaying due to lack of maintenance. In 2006 however decision was taken to revitalise the Kirikiri area and parts of the terminals (26 ha on KLT I and 16 ha on KLT II) were set apart for concession to private investors. KLT I was to be dedicated to general cargo traffic, whereas KLT II was to be dedicated to container storage. The area to be conceded included a 1,000 m long quay wall on KLT I and a 760 m long quay wall on KLT II, as well as sheds, warehouses and offices.

Ports OBC Certificate of Compliance was issued to NPA for the Kirikiri Lighter Terminals 1&2 on October 28, 2016 to obtain FEC approval to proceed to the procurement phase.

Evaluation of Technical proposals for the concession of Kirikiri Lighter Terminal II (KLT II) was held on 5th – 6th October, 2017 at Lagos.

12 Federal Ministry of Transportation/ National Inland Waterways Authority Rivers Ports Concession (Onitsha River Port):

The FGN adopted PPP arrangements to develop four river ports in the Lower Niger, namely:

i.            Onitsha

ii.            Lokoja

iii.            Baro and

iv.            Oguta River Ports.

Onitsha River Port was selected as the pilot case. The World Bank is sponsoring the project development and procurement phases for the Inland Port Concession.

13 Federal Ministry of Transportation / NPA Port Single Window:

The project involves the introduction of electronic single window platform that can effectively coordinate all port related/cargo clearance activities capable of potentially transforming port operations to a seamless, paperless system by eliminating redundant procedures and duplications.

14 Federal Ministry of Transportation / NPA National Freight Intelligence and Transportation Hub (NAFITH):

The project involves an application of information and communications technology (ICT) in the management of transport problems. It seeks to leverage on new innovation to provide needed solutions to the teething transport problems in Apapa.

15 Federal Ministry of Transportation / NPA Koko Port Concession:

FGN is seeking to grant a new Concession over the Koko Port in 2017. NPA is conducting hydrographic studies to determine the best way the channels leading to Koko port could be optimally utilized. The transaction described herein will consist of the contiguous NPA lands and NPA facilities between the river and the public roadway that runs behind the port property and including the area behind the existing quay. The transaction for this general cargo port will consist of a 180 m quay and apron, and a transit shed.

A plan view of the Koko Terminal lease will consist of the following facilities:

  • A 175 m long quay and apron;
  • Additional waterfront for future expansion;
  • A five-bay transit shed;
  • The port administrative buildings and entrance gate;
  • Port support buildings including the fire station, security police building, the power station with backup generator, and the maintenance shops; and
  • A disused warehouse and miscellaneous buildings behind the quay area, and all other lands and buildings inside the Koko Port perimeter.

Not included in this transaction are the jetty and other facilities or equipment currently used by Tower Petroleum for bulk liquid (bitumen) handling.

16 Federal Ministry of Transportation / NPA) Ikorodu Lighter Terminals:

The port is dedicated to salvaging unclaimed or overtime containers in the ports, with a view to providing needed solutions to port congestions and pave way to smoothen the new concessionaire’s operations in the ports.

17 Federal Ministry of Transportation / NPA) Provision of Utilities to the Ports:

The FGN is desirous in using PPP procurement method for the provision of utilities to the ports. These include, but are not limited to the provisions of power and water.

18 Federal Ministry of Transportation / NPA) Lekki Deep Sea Port

The project plans to handle about 1.2 million twenty-foot equivalent units (TEU) per annum, with berthing for vessels of 160,000 dead weight ton (DWT) capacity. The president granted the approval of contract agreement on 27th February, 2002 for the Lekki Deep Seaport project.

Ports The next step is for the concession to secure firm funding from investors. However, while the Lekki Deep Sea port concessionaire has long been on site, the concessionaire has been unable to reach financial close on project. Procurement
19 Federal Ministry of Transportation (FMoT) / NPA) Development of Deep Sea Port in Badagry, Lagos:

The Badagry Port project is a Greenfield development designed  to cater for containers, dry bulk, liquids,  Ro-Ro,  oil  &  gas  supply  services,  and also operate a free  trade and local logistic zones.

Ports The Commission issued an OBC Compliance Certificate on 29th December 2015 to enable the Ministry seek FEC approval which was granted on 3rd August, 2016. Development
20 Federal Ministry of Transportation / NPA) Construction of Olokola Deep Seaport:

This project at the Olokola export processing zone is a joint venture between the Federal Government of Nigeria, Ondo and Ogun State Governments in Partnership with Messrs Royal Terminals Ltd under PPP arrangement. The port is to be dedicated to the handling of oil and gas as well as other bulk liquid cargoes.

21 Federal Ministry of Transportation / NPA) Construction of Berth 21 at Terminal E, Lagos Port Complex, Apapa:

NPA entered into a PPP arrangement with a private company (Greenview Development Nigeria Limited) to develop an additional Berth in Apapa port.

 

Ports The Commission issued a Full Business Case (FBC) Compliance Certificate on 28th March, 2014 to enable Ministry of Transportation seek  FEC approval for the project.

22 Federal Ministry of Transportation (FMoT) / NPA Proposed Industrial Port Complex Development (Standard Jetty) by Modandola Group:

Modandola Group and its international partners proposed to develop a port complex in Apapa, Lagos. The proposed port complex will comprise a Berthing and Cargo Terminal.

Ports Conditional No objection for the OBC granted on 28th August 2012 by ICRC subject to the Ministry fulfilling certain conditions. ICRC granted a No objection for the FBC on 26th August 2013, currently awaiting FEC approval for the project. Procurement

26 Federal Ministry of Transportation / Nigeria Shippers Council (NSC) The Dagbolu Inland Container Depot (ICD):

The project involves the development of a Greenfield ICD in Osun State, South-West Nigeria. The ICD is being developed to exploit the strategic advantages in Nigeria’s huge export and import market by making the country a trans-shipment hub for the West African region. The ICD when developed shall provide storage and cargo handling facilities for export and import of containerized cargos to and from the hinterland of Nigeria especially around the Southwest states of Ondo, Ekiti, Osun; Edo State and Kwara State.

Ports The Commission issued an OBC Compliance Certificate on November 17th, 2014 to enable NSC seek FEC approval to proceed to the Procurement phase. Development
27 Federal Ministry of Transportation / Nigeria Shippers Council (NSC) Development of Container Freight Depot (CFD) in Ogwashi-Uku, Delta State:

This has a design that consists of an annual 5000 Twenty-foot Equivalent Units (TEUs) capacity facility which can be expanded with increasing throughput. The site measures approximately 100 hectares.

28 Federal Ministry of Transportation / Nigeria Shippers Council (NSC) Development of Inland Container Depot (ICD) in Onitsha, Anambra State: This has a design that consists of an annual 5,000 TEUs capacity facility which can be expanded with increasing throughput. 29 Federal Ministry of Transportation / Nigeria Shippers Council (NSC) Development of an Inland Container Depot (ICD) in Lolo, Kebbi State:

The FGN, as part of the Economic Reform Programme, approved the setting up of Lolo Inland Container Depots (ICD) to provide port services to shippers.

Outline Business Case (OBC) received from the Nigeria Shippers Council (NSC) in respect of the unsolicited proposal developed by Deltatlantic Nigeria Ltd.

30 Federal Ministry of Transportation / Nigeria Shippers Council (NSC) Development of Inland Container Depot (ICD) in Benin, Edo State: The Benin Dry Port is proposed to act as a port of destination for container cargoes waiting for further delivery instructions.  It is also proposed to provide services for the unloading of full container loads and breaking them down into smaller lots per consignee.

The primary objective of establishing the BENIN DRY PORT is to provide a one stop cargo reception and clearance facility to boost exports from and imports into Edo State particularly and Nigeria’s South-South, South East and some States in the Middle Belt regions in general. It is expected to provide proper handling and logistics services which emphasize promptness, dependability and cost effectiveness.

31 Federal Ministry of Transportation / Nigeria Shippers Council (NSC) Development of Truck Transit Park (TTP) in Obollo-Afor, Enugu State:

The NSC proposes to facilitate the development of TTPs through PPP with facilities for short-term breaks as well as long-term parking services where truck drivers can get fuel, food, restrooms, showers and basic supplies like oil and spare parts as well as servicing and repairs of haulage vehicles. The Truck Transit Parks will have the following facilities including but not limited Gas Station, Hotel and Motel, Restaurants, Mechanic Workshop, Fire Station, Police Post, Automated Cargo Tracking System.

Ports The Nigerian Shippers’ Council in compliance with the guidelines of the Commission seeks the services of a Transaction Adviser to provide broad advisory services; to prepare an OBC to determine the project’s viability and bankability. Development
32 Federal Ministry of Transportation / Nigeria Shippers Council (NSC) Development of Truck Transit Park (TTP) in Lokoja, Kogi State:

The NSC also proposes to facilitate the development of TTPs through PPP with facilities for short-term breaks and also long-term parking services where truck drivers can get fuel, food, restrooms, showers and basic supplies like oil and spare parts as well as servicing and repairs of haulage vehicles. Submission and Evaluation of RfP took place 21st June, 2017 in NSC Head Office Lagos.

33 Federal Ministry of Transportation / Nigeria Shippers Council (NSC) Gombe Container Freight Station:

This is a green field project aimed at providing a common user facility outside the seaport area for shipping operators, logistics firms, freight forwarders and other relevant stakeholders to ease the movement of import and export cargoes to and from the hinterland.

In support of the project, the Gombe State Government has allocated about 128 hectares of land/site for the project.

34 Federal Ministry of Transportation / Nigeria Shippers Council (NSC) The development of Sugar and Grains Terminal at Tin Can Island Port Complex:

The proposal is to upgrade the existing berthing, cargo handling and storage facilities for the use of sea going vessel utilizing the Lagos Ports in order to increase capacity to cater for dry bulk and limited general cargo as well as increase the capacity of the Lagos port.

35 Federal Ministry of Transportation Development of the Bakassi Deep Sea Port:

The Cross River State Government (CRSG) as part of its infrastructural development, plans to develop a deep sea port at Bakassi under PPP arrangement, in pursuance of which it sought the collaboration of the Federal Government of Nigeria in accordance with existing legal framework for port development in implementing the proposal.

Negotiation with Feedback Infrastructure Services, the prefer bidder for appointment as Transaction Adviser for the development of an Outline Business Case (OBC)  was held at the Federal Ministry of Transportation from September 14 – 19, 2017.

 

After the negotiations, the actual savings was N178,072,000.00.

The FCTA is desirous in using PPP procurement methodology in the provision of rolling stock, additional stations, maintenance depots and operation of the system

Concession of the Narrow Gauge: Eastern Railway (Port Harcourt to Maiduguri); Western (Lagos to Kano) railway lines in the Country:

The total length of the narrow gauge system is about 3,500km excluding passing loops and sidings.  The Lagos to Nguru via Kaduna section with branch lines to Apapa, Idogo, Baro and Kaura Namoda (Western Line) was built between 1898 and 1915 and measures 1,800km and the Port Harcourt to Maiduguri via Kafanchan section with a connecting line from Kafanchan to Kaduna and branch lines to Eleme and Jos (Eastern Line) was built between 1914 and 1926 and the 1960 and measures 1,700km.  The two lines are interconnected by a link between Kafanchan and Kaduna.

Rail African Finance Corporation (AFC) Consortium was appointed as TA by the Ministry to support the Concession exercise.
OBC Compliance Certificate was issued to FMoT on April 7th, 2017, subject to meeting some conditions at the FBC level.FMoT are negotiating with the GE Consortium on Concession agreement.

The Independence building was built in 1959. The building consists of 25 floors, has approximately 8,100 square meters and a separate parking lot directly opposite with an area of 2,650 square meters.

The proposed NTIBC building will be a mixed-use facility to cater for businesses on a let basis, provide space for TBSMB and also residential usage.

The contracts for rehabilitation and modernization of select Federal Teaching Hospitals (8 in phase 1 and 6 in phase 2) were awarded in November 2002 and September 2006 respectively to VAMED Engineering Ltd and a Presidential Project Implementation Committee was set up to monitor proper and timely execution of the projects.

The remaining 7 Teaching hospitals were supposed to be rehabilitated and modernized through PPP and a Technical Working Group (TWG) with membership drawn from FMOH, NSIA, ICRC, and four members from private sector was set up to deliberate and agree with VAMED/CPL Group on the most suitable PPP model to be adopted for phase 3.

90 Federal Ministry of Education Computer Based Test Centre (National Business And Technical Examinations Board):

The Computer Based Test (CBT) Centre project is to enhance efficiencies of candidates in Technical and Vocational Education through Information and Computer Technology.

 

Education The Project is currently functional but the NABTEB has been asked by the Commission to forward relevant documents on the project to the Commission.

The Business Case and Executed Contract Agreement were reviewed and it was found that it did not satisfy the key features of PPP contracts. The Commission requested additional documents to incorporate the issues raised.

91 Ministry of Information and Culture: Development of National Council for Arts and Culture’s land through PPP: The Council is desirous of developing an edifice on its parcel of Land located at Central Business District, Abuja through PPP that will comprise the following:

i.  Culture and Arts Theatre

ii. Office Development for use by

iii. Conference and event exhibition

hall; and

iv.    Shopping Mall

i.                    Establishment of Federal Ministry of Environment’s Clean and Green Campaign to end open defecation in public areas by 2019 by providing Public Toilets nationwide. Pilots to be in FCT public schools, motor parks and market places; and extended to the 36 States.

ii.                  Framework for Plastic Industry and other private sector companies to take plastic waste off the streets by 2019

iii.    Development of a New Head Office for the Federal Ministry of Environment (to be completed in 2018)

95 Federal Ministry of Industry, Trade and Investment Development of Okerete Transnational Border Market at Saki West LGA, Oyo State

The Federal Ministry of Industry, Trade and Investment wants to establish transnational border markets to promote regional integration, create employment in rural areas and reduce high incidence of smuggling across Nigeria’s borders. The intention is to create them at 6 geo-political zones of the country starting with Okerete, in South West region.

It was unanimously agreed at the Technical Committee meeting that the road leading to the site should be graded and tarred as well as constructing a bridge that will link Nigeria and Republic of Benin.

The project is an unsolicited proposal submitted by Kilowatt Electrics Limited (KWEL) to the Nigerian Electricity Management Services Agency (NEMSA). KWEL is proposing a joint venture partnership with NEMSA to operate the transformer repairs workshop in Ijora Lagos and construction of transformer repair workshops in Port Harcourt and Kaduna centers. The partnership will also include the role of electrical inspection, testing and certification of all electrical installation hitherto performed by NEMSA.

Wupa Water Treatment Plant Project on a Build Operate and Transfer (BOT) PPP model to produce electric power from the effluent discharge from the plant.Power generation capacity is estimated at 3,346.29kW/day which would power the WWTP and also provide the input for the production of fertilizer and plastics.The power plant is expected to sell excess power to the national grid.
